1. Who We Are

BENFEX ("we", "us", "our") is a multi-tenant ISP billing and hotspot management platform operated from Nairobi, Kenya. We provide software services to internet service providers (Partners) and their end-users (Customers). For data protection purposes, BENFEX is the data controller for Partner accounts. Partners are data controllers for their own Customers.

2. Data We Collect

• Partners: Business name, email address, phone number, account credentials, subscription payment history, router and network configuration data.
• Customers: Username, full name, phone number, email address (optional), WiFi session logs (start time, end time, data consumed), payment confirmation data.
• Technical data: IP addresses, device identifiers, browser type, and access timestamps collected automatically during use of our platform.

3. How We Use Your Data

• To deliver and maintain the BENFEX platform and its features.
• To process subscription payments and send billing notifications.
• To provision WiFi access and manage hotspot sessions.
• To send transactional communications (payment receipts, plan expiry reminders, account alerts).
• To investigate abuse, resolve disputes, and comply with legal obligations.

4. M-Pesa Payments

Payment processing is handled by Safaricom's M-Pesa platform (Daraja API). When you initiate a payment, your phone number is passed to Safaricom to trigger an STK push. We receive only a payment confirmation (amount, transaction reference, timestamp) — we do not store your M-Pesa PIN or full account details. Safaricom's own privacy policy governs their handling of your payment data.

5. Third-Party Service Providers

We share data with the following categories of third-party providers solely to deliver our service:

• Safaricom (M-Pesa): Payment processing.
• SMS gateway providers: Delivery of SMS notifications.
• MikroHub: VPN tunnel relay for MikroTik router connectivity.
• Hosting providers: Cloud infrastructure for platform uptime.

We do not sell, rent, or trade your personal data to any third party for marketing purposes.

6. Data Retention

We retain your data for as long as your account is active. Upon account closure, personal data is retained for seven (7) years to comply with Kenya's tax and financial record-keeping obligations, after which it is securely deleted.

7. Your Rights

Under the Kenya Data Protection Act, 2019, you have the right to access, correct, or request deletion of your personal data. To exercise these rights, contact us at support@benfex.net. We will respond within 30 days.

8. Security

We implement industry-standard security measures including encrypted connections (HTTPS), hashed passwords, and access controls. No system is completely secure; please notify us immediately if you suspect any unauthorised access to your account.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify active Partners by email at least 14 days before material changes take effect. Continued use of BENFEX after that date constitutes acceptance of the updated policy.

1. Acceptance

By registering for or using the BENFEX platform, you agree to be bound by these Terms of Service ("Terms"). If you are registering on behalf of a business, you confirm that you have authority to bind that business to these Terms. If you do not agree, do not use BENFEX.

2. Eligibility

• You must be at least 18 years of age.
• Partners must be legally registered businesses or sole proprietors operating in compliance with applicable Kenyan telecommunications and business regulations.
• You must provide accurate and complete registration information and keep it up to date.

3. Partner Accounts

Each Partner account represents a single business entity. You may not share your login credentials or allow multiple organisations to use one account. You are responsible for all activity that occurs under your account, including the actions of sub-users (agents, sales staff, report viewers) you create.

4. Partner Obligations

• Provide internet services to your customers in compliance with all applicable laws, including the Kenya Information and Communications Act.
• Obtain any required licences for operating as an internet service provider or reseller.
• Not use BENFEX to facilitate unlawful activities, spam, or abuse of network resources.
• Maintain current contact and payment information on your account.

5. Subscription and Payment

• Partners pay a monthly subscription fee corresponding to their chosen plan, payable via M-Pesa.
• Subscriptions are billed monthly in advance. Payment is due before the subscription period begins.
• A 3-day free trial is granted to new Partners on first login. No payment is required during the trial.
• A grace period of 3 days is granted after a subscription expires. During grace, the account is read-only. After grace expires, the account is suspended.
• Subscription fees are non-refundable once a billing period has commenced.
• We reserve the right to adjust pricing with 30 days' written notice to active Partners.

6. Plan Limits

Each subscription plan carries limits on the number of customers, routers, and sub-users you may add. Exceeding a limit blocks the relevant action and prompts an upgrade. Limits apply at all times, including during the grace period.

7. Intellectual Property

BENFEX and all associated software, trademarks, and content are the property of BENFEX or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for your business operations during an active subscription. You may not copy, reverse-engineer, or resell the platform.

8. Termination

• By you: You may cancel your account at any time by contacting support. No refund is issued for the remaining subscription period.
• By us: We may suspend or terminate your account immediately for breach of these Terms, non-payment beyond the grace period, or activity that poses a risk to the platform or other users. We may terminate for convenience with 30 days' notice.
• Upon termination, your data is retained for 7 years per our Privacy Policy, after which it is deleted.

9. Limitation of Liability

To the fullest extent permitted by law, BENFEX's total liability to you for any claim arising under these Terms shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim. We are not liable for indirect, consequential, or loss-of-profit damages.

10. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

11. Changes to These Terms

We may update these Terms at any time. Active Partners will be notified by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.

1. Scope

This Service Level Agreement ("SLA") applies to all active BENFEX Partner subscriptions. It defines our uptime commitments, support response targets, and the process for claiming service credits. This SLA does not apply to free trial accounts.

2. Uptime Commitment

BENFEX commits to a monthly uptime of 99.5% for the core platform (web application, API, and billing engine), measured on a calendar-month basis. Uptime is calculated as:

Downtime is defined as the platform being completely unreachable (HTTP 5xx on all endpoints) for more than 5 consecutive minutes, as recorded by our monitoring systems.

3. Scheduled Maintenance

• Scheduled maintenance is performed during the maintenance window: Sunday 02:00 – 06:00 EAT.
• We will provide at least 48 hours' notice via email for any maintenance expected to cause downtime exceeding 15 minutes.
• Scheduled maintenance downtime is excluded from uptime calculations.

5. SLA Exclusions

The uptime commitment does not apply to downtime caused by:

• Scheduled maintenance (see Section 3).
• Force majeure events (natural disasters, power outages, civil unrest, acts of government).
• Third-party service failures beyond our reasonable control (Safaricom/M-Pesa outages, MikroHub infrastructure, DNS providers, CDN providers).
• Actions or omissions by the Partner, including misconfigured routers, invalid API credentials, or abuse of the platform.
• Free trial accounts or accounts in a suspended or grace-period state.

6. Service Credits

If monthly uptime falls below the commitment, Partners on a paid plan may claim a service credit:

Credits are applied to the following month's invoice. To claim, contact support@benfex.net within 14 days of the end of the affected month. Credits are the sole remedy for SLA breaches and are not redeemable for cash.

7. Measurement

Uptime is measured from BENFEX's internal monitoring systems. Partner-reported incidents that are not confirmed by our monitoring do not qualify for credits.
